788 Survived The Supreme Court, But Just Barely

  This should terrify every medical marijuana patient and business. You can thank the authors and people behind 806 and 807 for risking the entire medical marijuana program. As you know, they withdrew 806 and filed 807. Paul Tay challenged 807 on the basis of the Supremacy Clause arguing that since its federally illegal to possess medical marijuana, the state can’t consider a ballot petition that would be contrary to federal law. The Oklahoma Supreme Court is made up of 9 Justices.
​  In a VERY CLOSE VOTE, as outlined below, they ruled that the Supremacy Clause does not kill SQ807. Now, we all know that I think 807 is garbage and should be thrown in the trash. I’m just glad that the Oklahoma Supreme Court did not kill it on this issue. If they had, 788 WOULD BE DEAD!!!! These people are risking it all, for what I ask you? Nothing!!!
​  Please let’s ensure that they don’t get the signatures needed so we don’t have to challenge it further. Anyone running a petition on the issue of medical marijuana is risking 788 entirely. Vote went as follows:

¶44 Gurich, C.J., Kauger, Winchester, Edmondson and Combs, JJ., concur;
¶45 Darby, V.C.J., Kane (by separate writing) and Rowe (by separate writing), JJ., dissent;
¶46 Colbert, J., not participating.

1. Quick Update on the health situation.
2. Lawsuit filed today about the 2 year residency requirement and the 1,000 foot rule (see post just before this one for a link to the lawsuit). Meeting with the receptive Mike Hunter soon to discuss resolution of the case (thanks Representative Echols).
3. Updates about Patient Information, the HB 3228 Veto, and OMMA Regulations.
4. Meeting with OBNDD.
5. Fundraisers for Representative Jon Echols and Representative Scott Fetgatter and some surprise Oklahoma Senate candidates on July 20th in Tulsa and July 23rd in OKC.

Stitt Weighs Executive Orders To Remedy Medical Marijuana Rules

ALERT About HB3228 & ILLEGAL influx ​of product from out of state. 

  See the message direct from the Governor regarding HB3228. I can confirm, yes, solutions are still being worked on. To disagree with the Governor, I think a Special Session could be called.
  He is correct there is construction, as we saw them pulling desks out of the House chamber last time we were there, but that’s not a very valid reason. Regardless, as I’ve said before, it is clear now that delivery was the big issue for Governor Stitt. That’s actually helpful to know for sure. I don’t think the seed to sale system has anything to do with that, and the statement reflects a lack of full understanding how that works, but I believe he believes it’s essential. I’m not sure where he sources his information, but we need to work to get him better and more educated sources.
  We have to take it upon ourselves to educate him and those that advise him and the legislature on these areas where they seem to have terrible information (It would be helpful if Governor Stitt would take a meeting about this, hint, hint). I’ve expressed my own concerns that delivery could present a myriad of problems, so I understand some hesitation.
