SoonerPolitics has received a disturbing letter which alleges gross violations of civil rights, and a Lawton man is still sitting in jail. His cash and gun collection was seized by the police who raided his home at 6am, on October 4th. He says there was a no-knock warrant. He's been sitting in jail since then. Prior District Court records show only a traffic ticket for not having an insurance certificate on hand, in 2014.
William Keith Davis says he is a properly licensed patient in compliance with Oklahoma medical marijuana laws. His handwritten letter mentions he was growing his authorized 6 cannabis plants in his back yard. When police barged into his home, most of his firearms were in a safe. He says he was thrown head first into a pool table. He insists that he told them he is licensed to have the medicine. When the police found his small amount of medicine, they took all of it and some baggies in his kitchen. they claim that the baggies are evidence that he is a distributor. His mature plants were immediately pulled up by the roots, destroying them and resulting in a loss of over $2000 in homeopathic medicine. Davis says he was immediately arrested and has been in the Comanche County Jail ever since. His case was set to come before Judge Zwaan, yesterday. We were not able to get a status report. His complete gun collection and the $549 in cash found in his home are now in asset forfeiture, so he cannot use any of that as collateral for bail. Without bail, he's not been able to resume employment and hire proper legal counsel. The courts can keep him locked up and delay trial until October. He was required to provide a Cash Bond of $20,000, which he does not have, so he sits in the county jail. |

The problems are made worse because of the severe dysfunction of district court in Comanche County. Judge Zwaan has this case, but is overloaded with several of Judge Irma Newburn's cases. Newburn's been recused because she essentially kidnapped and imprisoned the Asst. D.A., Jill Oliver, who's assigned to prosecute this case.
Below is a civil asset forfeiture action whereby the state prosecutor claims he can take cash and property used in a drug crime. This became the means of keeping Mr. davis in jail, since he appears to lack any other collateral for a bond.
