Okla Tax Commission Calls Off Attempt To Apply Tobacco Tax on Medical Marijuana

"We made a mistake", says the tax collectors.

  Last week several dispensaries reported that an agent of the Oklahoma Tax Commission entered their local shops and demanded payment of Tobacco Taxes on some Marijuana Medicines; in addition to the Retail State & Local Sales Tax, and the Marijuana Excise Tax.
 Noted Cannabis Industry Attorney, Ron Durbin, published the demands to consumers and shops across the state and asked citizens to express their input on the agency-created requirement.
  Today Durbin posted the following update to his clients as well as the advocates, patients, and Cannabis business proprietors.
  The voters directed that cannabis medicines would be subject to a 7% tax on retail sales.  But the OTC perverted the intent by declaring that the text teally meant to call it an excise tax and then the OTC declared that a full state & local sales tax must also be charged. This more than doubled the effective tax rate.

Sales Reps Face Jail Because of Gaps In Oklahoma Law

  Oklahoma is experiencing a full blown industry explosion for cannabis medicines. Each of the past 5 months have seen a 33% increase in statewide sales tax increases over the prior month. If this continues just a few more month, Cannabis excise & sales taxes could overtake liquor tax collections in Oklahoma.
  But along with the explosive sales growth, many problems are now presenting, for law enforcement who have little training on the massive changes and how to determine who is a legal medicine distributor and who is a black market cartel operative. Sheriff Damon Devereaux of Logan County just recently had to return a large shipment of medicine to an Enid producer and drop all charges against two transport workers whom his department accused of running contraband drugs.
  The problem for law enforcement is that the legislature failed to provide a proper state certification of transport employees for company who grows, processes, or retails cannabis (marijuana).

Sheriff Admits Mistake, Returns Legal Marijuana, But No Apology?

It finally happened.. an Oklahoma sheriff called & said; 'come get your marijuana'. 

 Legal transport of Oklahoma Medical Marijuana was seized earlier this month along the trek from Enid, to Edmond. Logan County Sheriff Deputies were in a routine traffic stop when they discovered a large shipment & over $5000 in cash. Two employees were in the midst of their deliveries in the 'cash-only' Oklahoma medicinal cannabis enterprises.
  Sheriff Damon Devereaux of Logan County, says his deputies seized all of it and arrested the two employees, despite all their cooperation and attempts to explain the new laws. The deputies have many years of experience in dealing with the black market cartels and significant ongoing training to identify the signs of trafficking drugs. Evidently this transport just seemed more similar to black market activity, so the cops let their training kick in.

Tulsa Embezzler Steals $420K from Employer: Will He Get the Brinkley Deal?

  A 70 year old Tulsa man just pleaded guilty to embezzling more than $420,000 from his employer, American Parking. It was largely done through paperwork fraud and approving payments to an account of an unnamed 3rd party. This made BancFirst a named victim and made it eligible for federal courts to punish. He pled guilty and will be sentenced on October 23rd, in Tulsa.
  This scenario is very similar to the high profile case of former senator Rick Brinkley, who embezzled $1.8Million from his employer, the Tulsa Better Business Bureau. Over a 10 year period, Brinkley used BBB funds to cover his gambling addiction at Oklahoma Indian Casinos. Those casinos will not be required to return any of the stolen money, that we are aware of.
 Brinkley spent just over 3 years in federal confinement and got to stay at a federal prison here in Oklahoma (El Rino). When we break down the scale of crime:punishment, each $100K in embezzlement netted just 2 months of incarceration. It's what we call "the Brinkley standard". If Tulsa federal courts are at all consistent, Jerry Wiley will serve less than 9 months in federal lock up for the entirety of his crimes.

Shoppers Holding Off Clothing Purchases For Next Weekend's Tax Holiday

  We are now in our 12th annual celebration of the consumer's best holiday of the year. It's the weekend when apparel purchases are sold to consumers without the state & municipal govts. imposing(extorting) a tax of 8-10% in most locales.
  The more disciplined consumers are beginning to catch on and save their scheduled shopping until the annual holiday. In preparation for the event, the Oklahoma Tax Commission has published a set of frequently asked questions. We've posted them in this article, at the bottom of the page.
  Imagine the impact on global markets when the US Dollar spikes in money market exchanges by nearly 10%. The national economy gets a boost but exports suffer, as a result. This event has no such downside except in it's impact on sales prior or after the tax holiday weekend.
  Some of the floor debate over the 2007 law was based on the cost of back-to-school shopping, which had gotten outrageous when many public schools mandated a dress code which required school uniforms without exception.

The Nation's Civil War Rhetoric Intensifies

  The vitriol and hostility in our nation is reaching levels we haven't seen since the late 1960s. 
  The home turf of the counter culture is now openly showing their intolerance and aggression toward the male gender and the people whose skin is white. None of the words of Ilhan Omar's hostile quote even infers that intolerance is the problem she fears. In fact, she openly embraces her own intolerance.  She is not alone, but she has become the poster image of the violent and intolerable left. Last weekend that intolerance was on display in Oklahoma when a mob took over some roadways in Lawton, OK.  A thug wearing a "Punch Nazis" shirt decided that a lone marcher with an alternative view should not have the same access to the public streets.
​ Imagine the social outrage if a Republican congressman openly said; "America should be more fearful of Colored Women". His political career would be over.

Trump's Kindred Spirit Becomes Prime Minister of the United Kingdom

The man who once said;
  "My chances of being PM are about as good as the chances of finding Elvis on Mars, or my being reincarnated as an olive.";
is now in charge of the present and future United Kingdom.
 Boris Johnson is a native American, born just minutes away from Trump Tower and in the shadow of the United Nations world headquarters.
  But Johnson is a firebrand of British independence from the mess that the European Union has become. He's been a staunch conservative and outspoken advocate of the Brexit inevitability.
  This development and the collapse of Theresa Mays' government is a unique opportunity for Donald Trump to move forward on global objectives and shake the label of isolationist.  Trump has long held out for deals with international strategic allies which maintain national independence and goals. the fact that Boris Johnson is of the same mindset for Great Britain, just adds ideological strength to Trump's argument.
 Though Johnson was born with dual citizenship, he was educated in Europe and became a journalist. He renounced his US citizenship and eventually entered elective politics.

Police Abandon Part of Lawton, Socialists & Anarchists Take Over Roads

  The Oklahoma Dept. of Public Safety was in gross dereliction of duty this past weekend, when about 1500 defiant protesters and the American Civil Liberties Union gathered in the streets and highways of Lawton, Oklahoma. 
 What ensued for about 2 hours was a complete shutdown of federal interstate and municipal roads. One courageous supporter of the federal govt, Tim Harper, was illegally assaulted, corralled, detained, and harassed by several conspiring participants of the seditionists.
​ Harper remained quiet during his interaction, only seldomly and respectfully requesting the gang surrounding him to let him move on freely.  Harper is a licensed open carry citizen and he indicated that his personal firearm stayed in it's holster.
  The seditionists shut down all traffic for most of the unlawful event, infuriating local residents who continually asked "Where is the law enforcement"? One local woman told news crews that emergency responders are not able to attend to crisis because of the rebellion taking place.

The Addictions of the Legislature

  Oklahoma has a very young legislature, and the freshman class has almost too much power, and a vast lack of perspective. That being said, they are who we sent to the capitol to address our state issues.
  And now the dysfunctions of the federally screwed up priorities are visited upon the sensibilities of the Oklahoma people. How do we respond? Do we become a part of the federal dysfunctions or do we become a voice of reform on a national scale?
  The federal problem is an ill-conceived and corruptly administrated federal program called ObamaCare. Unlike a sensible response to a catastrophe, this program is creating a catastrophe by it's very existence.
  • It encourages massive cost inflations in health services which exploit it.
  • It discourages frugality and market forces. 
  • It completely and fraudulently breaks the promises of lower healthcare costs, greater healthcare options, and better insurance products.

Park Rangers Bust Illegal Aliens Near Turner Falls

   The female officer spared the children and made effort to get them safe transportation home. But the adults had no documentation and admitted being from Mexico.
  How long is this going on? The Turner Falls area has long been a popular attraction for the Latino community, but most Oklahoman's believed they're largely Texans who came up from Dallas and surrounding areas.
  The Chickasaw National Wildlife Area is a national park. The National Park rangers are tasked with keeping order.
  Officer Boss states in the video that she came earlier and gave a verbal warning about very loud music which other park visitors complained about. She says that when she returned a 2nd time, she saw liquor (which is banned in all national parks). When she began to cite them with the infractions, she found out that they only had Mexican IDs. That's when she (as a federal law enforcement officer) had to also enforce federal immigration laws, against those who also violated other federal laws.
  We're trying to find out what process the federal rangers applied to this case? Were deportations actually ordered? Or did the rangers simply kick them out of the park and forget about the incident?
  Predictably, many are crying 'racism'.

Wagoner Mayor Welcomes Cannabis Industry

Wagoner Oklahoma is going all in for the medical cannabis & industrial Hemp industry. Their once flourishing downtown district now has several buildings vacant & in disrepair. They want medical cannabis proprietors to fill them up, and the city is willing to accommodate the new businesses.
Investors already decided to buy a 35,000 sq. ft. building in downtown, as well as 49 acres of land to start growing plants.
"It's very new for a small town in Oklahoma to embrace the cannabis industry as Wagoner has," said Mark Mckinney, president of The Wagoner Grow.  Mckinney said it plus the acres will add 140 jobs to town in the next year."The great revival of Wagoner is going to put people walking up and down Main Street again in Wagoner. Open restaurants and consumer lounges, and microbreweries, apartment places people want to hang out and even more too," said Mckinney.
Mayor Albert Jones said this is exactly what the town needs, especially after a fire burned through several historic downtown buildings in 2017.
"This is definitely a big game changer for our city. We could be the hemp capitol of medical cannabis capitol of Oklahoma," said Jones.

Medical Marijuana Patients Help Train Cops On Impairment

  Nathan Rees is both a former police chief and a current cannabis medical dispensary proprietor.  This week he played an important role in bringing together medical patients and law enforcement in a very important training for cops and communities.
  The Muskogee regional airport was transformed into a road course for demonstrating the impairment impact of 3 subgroups of drivers:
  •  those who text (or otherwise are distracted) while driving
  • those consuming liquor, then driving
  • those consuming cannabis(marijuana), then driving
 Nathan is comfortable with lots of folks, including the cops who interact with them. That made him a crucial part of making this a successful day.

Feds Say Pawhuska Cops Cannot Inhibit Kentucky Licensed Hemp Commodities

  The legal office of the US Dept of Agriculture gave a red light to the Pawhuska Police dept. and District Attorney Mike Fisher. At the same time, the state of Colorado and the medical company who purchased the truckload of industrial hemp got a green light to file a federal lawsuit against the state of Oklahoma and the city of Pawhuska for the actions of the local police, last January.  District Attorney Mike Fisher (just sworn in on January 1st) is seeking a life sentence for 2 of the 4 members of the trucking entourage.
  Fisher believes his confiscated payload is not legal industrial hemp because some preliminary field tests could not guarantee that it's THC content is limited to 0.3% .  Fisher's rationale is that any exceedance of 0.3% then turns the payload into a Schedule 1 federally banned substance, without an Oklahoma Medical Marijuana Business license. Oklahoma House Majority Floor Leader, Jon Echols, wrote the state legislation on industrial 'trace' hemp which DA Fisher is supposed to be enforcing.

Pawhuska Fireman Accused of Assault On Elderly Woman

  A long-time Pawhuska resident says firefighter Lloyd Arnce  hit her and attempted to steal her smartphone, this past Friday. 
  Tjuana Kelley Boulanger was in Veteran's Park with her family & friends, including children. She was lending her assistance to a citizens effort to recall members of the local city council and collection petitions.
  She says that while they were eating lunch in the park, several municipal agency personnel swarmed the park and the Animal control officer blocked the rear parking lot entrance.  Two police dept. officers then came in, along with a member of the local fire dept.
  When Boulanger refused to cease her petition gathering, she asserted that state law bars the city from even creating such ordinances to ban constitutional free speech and assembly; and the right of petitioning the govt. for redress of grievance further guarantees her rights.
  The lead female officer politely backed down from demands and Boulanger went back to her lunch table.
  The two officers talked with the other responders and then left the park while Ms. Boulanger wished them a blessed day.
  But then the remaining firefighter got irritated that Boulanger's live social media video feed caught his image. 
That's when he started yelling as he crossed the parking lot.  The video clearly shows him grabbing at her and attempting to take her phone. He eventually gives up and walks away.
The trauma of all this happening to Boulanger and in front of a young girl was clearly impacting. She tells the viewers;
"The war is on! If I die today, I die making change."
  We contacted Boulanger over the weekend and asked what she plans to do about this. She told us that she is needing good civil rights council and she plans to file a police report.
  Boulanger wants a judge to order the city agencies not to interfere with petition gathering or harass the citizens involved in it. She wants the accosting firefighter charged with battery and attempted theft. He must immediately be suspended from the fire dept. while awaiting trial.

Pawhuska City Managers Resign - City Rehires Police Chief

Nick Silva returned to the Pawhuska Police Dept. Wednesday night, moments after the city rehired him. Several supporters were there to greet him.
  Rex Wikel, the man who may have masterminded the overthrow of the Police Chief, in Pawhuska, Oklahoma; is now resigned from the city's most powerful office.

  On Wednesday, after an emergency city council meeting, Wikel was out as city manager, and a new interim manager was swiftly hired. That interim manager was an administrative assistant last week. Tonya Bright now has vast authority to set the city back to order. She directed the city attorney to resolve the police chief matter. Within minutes Silva emerged from a private meeting an announced his return to the helm of the police dept.
​
  Just last Friday morning, Wikel was preparing to take over as city manager for the retired bank executive who was serving in the role for the past couple years. Larry Eulert's term was ending at the end of June, but his replacement was former Police Chief, Rex Wikel. When Eulert hired the younger former Tulsa Police officer, & former Osage Nation police chief; Wikel was evidently not a fan of the changes made to Wikel's former dept.
