Judge Delays Hearing On Emergency Covid Rules

Rules Suspended, Stitt May Call Special Session

  Just hours before today's scheduled court proceedings against Gov. Stitt & the ABLE Commission, A District Court in OKC rescheduled the proceedings to January 8th.
  All Injunctions against enforcement are also extended. This pertains to the early closure orders for all dining and nightclubs, as well as taverns. The plaintiffs argue that state laws and constitutional order was grossly ignored by the state, and no authority to impose penalties is established. The ABLE Commission has declined so far, to defend the rationale of legal foundation for the citations they have issued to several struggling Oklahoma establishments.
  Another development which might be related, was the hint from Governor Stitt that a special session may be called as early as next week. It was a comment he made at a press conference about vaccine distributions at nursing homes. He said some legal remedy is needed to facilitate video conference meetings of state & municipal agencies.
  Governor Stitt could simply request another statutory Health Emergency and activate a special session within 48 hours.  The move could lead to a 30-day granting of special powers for the governor, but the legislature would have oversight and could revoke the emergency any time within those 30 days.
  Plaintiff's attorney, Frank Urbanic, leveraged the same Health Emergency declaration last April, when he published an expose' on the tactics of the governor's office, utilizing what appears to be some type of unofficial martial law powers, based on a finding that Oklahoma was in a state of widespread riot and/or insurrection, last March. 
  Within hours of  SoonerPolitics and others republishing Urbanic's discoveries, the governor called the health emergency request of the legislature.

Citizen of the Year 2020: Frank Urbanic

  Civil Rights Attorney, Frank Urbanic, is our 2020 Citizen of the year for his efforts to hold state and local govt to respect and defend the federal & state Constitutions in their official duties.
  In a year like none other, 2020 is a memory we are all destined to never forget(sadly). But in times of trial, peril, and tyranny, those who remind us of our civilization's founding principles are especially to be valued. Those who rise up to champion the cause of individual liberty, societal virtue, and advancement of prosperity; they are to be esteemed.
  When we knew so little about a global virus from a Chinese laboratory, our nation had to revisit our founding principles and put them to the test. 
​When Governor Stitt first ordered a ban on large gatherings of people, Frank Urbanic researched official state documents and discovered some very troubling data. Urbanic published a blog post on his law firm's website, indicating that the governor seemed to have essentially declared that a state of widespread riot is endangering the state.  At least that is the implication of the Attorney general's legal notices.
  SoonerPolitics reposted the article on Thursday, April 2nd, and within hours the governor changed course and properly invoked a "Health Emergency Act" declaration,  & submitting a request of the legislature to grant him 30 days of special powers with legislative oversight.  As those 30 days came to an end, the governor was celebrated nationally as an example of how a state gets back up on it's feet and thriving.

Special Session May Come In Early January

 During a press conference at a vaccine location,  Gov. Kevin Stitt took one question regarding a special session to resolve meetings, voting, & public policy matters. He said he's been open to the idea of a special session 'if the pro temp and speaker want one'. 
  He did not specifically say that the special session would be precipitated by a Health Emergency Declaration, like the action he took in early April.  That statutory clause allows the proper implementation of emergency orders with a 30-day sunset and a legislative oversight committee.
  Recently, the governor appears to be making new laws on his own, by declaring either a state of civil unrest (riot & insurrection) or a natural or manmade disaster emergency. Neither of those last two categories are in any way applicable to the spread of a new virus strain, but the governor seems to prefer them as they allow him an open-ended sort of martial law powers.
   No previous governor has exercised so much emergency powers since Alfalfa Bill Murray declared martial law some 30 times in his tumultuous one term as governor in the early 1930s. Murray even led soldiers to war against Texas in a dispute over a border bridge near Durant.

Former Lawmaker, John Bennett Seeks OKGOP Chairmanship

The fiery floor debater of the Oklahoma House of representatives, John Bennett; is declaring his candidacy to lead the Oklahoma Republican Party in 2021. 
  Bennett has spent much of the past 30 years in national security and anti-terrorist efforts in military service. He has also spent years training civil law enforcement. As the first Republican ever elected in the 2nd House district (Sallisaw area), Bennett has been a unifying voice for common sense and bipartisan solutions which working  Democrats and Republicans largely support.  Bennett helped change Eastern and Southern Oklahoma into a solidly 'red' electoral region.
  Bennett was among the first elected officials in Oklahoma to support the Trump candidacy for president.   He's a husband and father & community leader. 
    Lawmakers of the past 10 years remember Bennett's back row fiery speeches advocating for fiscal responsibility and agency accountability, as well as parental rights and education reform.  Despite Bennet's advancement in House leadership, he always preferred the back row.
  Peace officers and other professionals in criminal justice have credited Bennett for bringing fundamental reforms and relief to our system of law enforcement and court adjudication.
  Bennett also serves as pastor of Lee Creek Assembly of God, near his Sallisaw home.

OK Legislature Ignores Inequities In Justice In Tribal Territories

  The Supreme Court's McGirt ruling of 2020 set up an unconstitutional 2-tier justice system in Eastern Oklahoma.  Our state legislature seems completely oblivious to the coming rage over the 'diplomatic immunity' that multiple thousands of our neighbors now claim.
  Some are hoping that the tribal courts will create commensurate laws so that every subject of this police state get the same harsh treatment. Many others are calling for Oklahoma to adjust our criminal code to reflect the federal statutes. For many crimes, especially white collar crimes; the stark contrast is an outrage to the 14th Amendment right of equal protections.
  Not one filed bill in the 2021 legislature addresses this inequity and denial of our 14th amendment rights of equal protection under the law.

Six Taverns Win Temporary Rights To Stay Open To 2am

  Frank Urbanic, an Oklahoma Civil Rights Attorney; just restored the rights of 6 Oklahoma taverns and restaurants, to remain fully open to the statutory 2am business hours.  A district court judge deemed that an injunction against governor Stitt and the ABLE Commission(the state agency enforcing statutory law and agency rules) were causing irreparable harm to several plaintiffs without first providing due process.
  Urbanic told Sooner Politics last week, that ABLE was beginning a practice of revoking liquor licenses if a tavern did not shut their doors at 11pm, daily. The problem with that is, The governor and state agencies were not establishing proper rulemaking procedures.
​  The Judge's act applies only to the 6 plaintiff restaurants & taverns,  because they were the only ones who fought back.  This ought to encourage more restaurants to defend their rights and claim their liberties; and hold the govt. to accountability.

What are proper agency rules?

  When an agency deems new rules are essential, they are required to publish such proposed rules and allow for a public comment period, to gauge the impact on the people.

Senate Live Event On Redistricting Software & Process, 9am Today

​The Oklahoma House of Representatives and Oklahoma Senate have planned a bipartisan, bicameral virtual demonstration of the redistricting software, Maptitude for Redistricting by Caliper, that both chambers will use to redraw new legislative and congressional district lines during the 2021 redistricting process.

As part of the Legislature’s transparency efforts surrounding redistricting, the public will be able to watch the virtual demonstration via livestream on the Oklahoma Senate website, https://oksenate.gov/live-chamber.

Tracy Horgan, the director of redistricting services for the Caliper Corporation, will provide a brief demonstration of the software capabilities for lawmakers at 9 a.m., Dec. 14, in Room 535 at the Capitol. Due to COVID-19 protocols, the demonstration will be conducted remotely and in-person attendance by lawmakers will be limited.

Urbanic: 'ABLE Threatens Taverns Using Made Up Laws & Fake Penalties'

  Civil Rights Attorney, Frank Urbanic just sent Gov. Stitt a 'cease & desist' request pursuant to a false declaration of a statewide disaster, or a widespread state of riot.
  Urbanic is attempting to help several taverns and restaurants who are being intimidated, threatened and perhaps punished with loss of business licenses because they are following statutory law rather than made up and uncertified orders of some Liquor inspectors for the state of Oklahoma.
  So far, Urbanic says that Gov. Stitt is pretending not to have gotten any letters notifying him of unlawful actions of his liquor agency leadership and inspectors.
  Under proper & constitutional protocols, the agency would publish a set of proposed emergency rules and list the reasons and rationale for why the rules accomplish the end goals. 
  That would be followed by a public comment opportunity and a final draft of rules being formally approved, then sent to the governor, who is the only person able to enact such emergency  rules and their punishments for infractions.

State Vaccine Rationing: Should Retail Clerks Be Pushed Behind School Teachers?

  Yesterday, the state's public school employee union complained that they are supposed to be the top priority, far above the retail clerks and service industry workers. And to be more specific, teachers of the least endangered demographic (youth) are wanting the state health dept to provide the OEA(Oklahoma Education Association) members with full & immediate covid vaccines even if it results in delaying vaccinations for emergency first responders (paramedics, firefighters, peace officers, etc). 
​  In a report published by MSN, Alicia Priest, head of the top teachers union said caring for the children means the union educators are supposed to be closer to first in line..
​Priest says if the State really wants to put our children first, that means putting educators among the first in line for the vaccine.

Roku TV Begins Power Move To Take On Cable Providers With New 'Live Channel Guide'

  Early this morning my Roku TV posted a 'splash screen' overlay notice. The message said that Live streaming TV channels are being added to my broadcast TV channel guide. I decided to dig further. What I soon discovered is a whole new and simple TV viewing experience. It's called 'Live TV Channel Guide'.

Some background..

  I cut the cord a few years ago, and have attached a reliable antenna to my TV. Having tested Roku 'set top boxes' since 2012, I now have a 'Roku TV' with the set top box built into the TV. I have several free streaming channels loaded, via my free Roku account. I pay nothing for any of these free channels. I get about 40 broadcast channels in the Tulsa metro area, and I probably have 120 various streaming & on-demand Roku apps installed into my TV.

The TV Wars..

  In the somewhat free market competition for viewers (and therefor advertisers), TV channels are constantly striving for market share.  Cable providers (including satellite & internet based) are also competing for market share. Cable providers insert their own advertisements  & generate revenue from both advertisers and cable subscriptions.
  Roku started out as a clunky & slow interface to provide 'on-demand' content. Viewers needed a 2nd remote for the Roku set top box. there were very few 'live channels' on Roku. But slowly, Roku and their partners innovated.
  Roku's best advantage is their 'open source' format where anyone could develop a channel. That led to tens of thousands of choices for consumers.  Samsung, Apple, and other set top streaming boxes were all 'curated' by corporate teams who make our viewing menus for us. But we hate censorship, right?

Consumer Experience Is Key

  The open source nature of Roku is just one aspect. But you need to be tech-savvy to program your own list of channels. So, in order to reach a broader market share, Roku needed to make it simple. They did some key things.
  1. Provide a curated option. Early on, there was a Roku 'channel' called Nowhere TV. It was a 'mini network' of dozens of the best early channels on Roku's platform. It went away, but the idea of curated content caught on with some big players.
  2. Make a Channel Guide. A geeky startup called Pluto TV started providing a 'dish network' style of content. It included a channel guide for surfing from channel to channel. It grew from nerdy reruns, B-movie networks, cat video channels and European news channels.  Viacom, the parent corporation of CBS & M-tv, bought out Pluto and loaded it with hundreds of new & better channels. It's now better than cheap cable packages, but totally free.
  3. Simplify the hardware. Roku started licensing their operating system for TV set manufacturers to create Roku TVs. That resulted in the simplest TV remote on the market. This put Cable providers at a huge disadvantage, as the typical cable remote is terribly complexed and requires weeks to fully master.
  4. Combine all channels into a master channel guide. This is now rolling out on some sets. Roku TV still separated their internet content from the broadcast live local tv interface. When a viewer wants to watch the local tv stations, they have a nice channel guide which most other 'smart' tvs don't have. Roku developed this guide just for local tv channels in the viewing area.  But Roku also spent years developing their own channel guide of curated live-streaming & on-demand channels. Roku developed the same channel guide for both local broadcast and The Roku Channel.  Now the two guides are merging into one, on the Roku TV operating system (9.4.0)
  Pluto TV is probably making a huge amount of money for Viacom. But Roku is essentially declaring war on Pluto with this Live TV Channel Guide. the difference will be in the curated content. Viacom may be able to keep Roku from offering the content that Viacom owns (CBS, Mtv, etc), but It's hard to beat the convenience of integrating a core channel guide in the base operating system. I expect an antitrust lawsuit to come from this. I also noted that the Roku Channel guide left out some channels that Pluto has. The F1RST is a news channel (Bill O'Reilly, Dana Loesch, etc) is not included in Roku's curated content . 
Last week, Roku posted a blog entry, discussing the upcoming merger of channel guides.  My Sharp Roku tv already got this upgrade, but my newer HiSense  Roku TV does not yet have it. I tried doing a system update, but that still didn't initiate the new feature.

Background
Roku TVs are equipped with an ATSC tuner that provides access to digital “over-the-air” broadcast television. These channels can be accessed via an HDTV antenna connected to the Live TV input on your Roku TV.

How do I connect an HDTV antenna?
​Depending on where you live, you may be able to receive free “over-the-air” TV broadcasts from nearby TV stations using an HDTV antenna. You can refer to Antenna Web for more information on accessing “over-the-air” TV in your area, and finding and using an HDTV antenna.
To access “over-the-air” broadcast television, the HDTV antenna must be connected to the Live TV input of your Roku TV.
  1. Connect the coaxial cable from your HDTV antenna to the “Ant/Cable In” connector on the back of your Roku TV.
  2. Turn on your Roku TV, go to Home and select Live TV. If Live TV is missing, you can add it by going to Settings > TV inputs > Live TV > Set up input.
  3. Follow the instructions on the TV screen to complete setup.
Note: The placement of the HDTV antenna can affect which TV stations you may be able to receive and the quality of the TV signal. It is normal for the initial channel scan to take a while.

Yes. When an HDTV antenna is connected to your Roku TV, a feature called Live TV Channel Guide can help you find information about “over-the-air” movies and TV shows broadcasting in your area today and in the coming weeks, along with details for programs offered for free from over 150 live streaming TV channels on The Roku Channel like ABC News, Lively Place, and more. With Live TV Channel Guide, your TV listings are combined into a single channel grid, letting you quickly find your favorite free, live TV.
You can access Live TV Channel Guide directly from The Roku Channel, or from the convenient Live TV channel tile on the home screen of your Roku TV. If you wish to hide streaming TV channels and only see information for "over-the-air" channels, you can go to Settings > TV inputs > Live TV > Hide streaming TV channels and select Hide all.
If you wish to hide the Live TV channel tile from the home screen, you can highlight it, press the Star button  on your Roku TV remote, and then select Remove input.

"Mask Mandates Are Leading To Higher Illness Rates", says OK Health Dept.

 Cities with a mask mandate in effect, now are showing more illness per capita than cities not mandating mouth & nose coverings.
​ In page 12 of the State Health Dept's weekly Covid19 report (a 44 page file), the state's top public health authorities are now saying that the mask mandates are associated with a 4% higher illness outcome, in the most recent tabulations.
  The masks were never intended to be the 'front line' strategy for curtailing viral spread. It was a recommendation for "when socially distancing of 6 feet or more cannot be maintained in a continual presence.   The ever-evolving narrative of our science experts are creating a serious skepticism of anything coming from public health advisors.
  What many of us were concerned about is a false security in masks which have led many to become far less vigilant about keeping personal distance and other sanitation safeguards. 
  We know that distancing works. We know that the consumer masks don't filter out virus particles.  the mask is only a muffler to keep us from spewing our 'exhaust particles' across the room.

Oklahoma Heading Toward A Rough January Covid Spike

  The testing statistics show a radically increasing 'doubling rate' of confirmed China Coronavirus cases in Oklahoma.  The summer spike receded from a 23-day doubling rate to a 59-day doubling of cases during the fall season.  But as November came, the rate has moved to a current 48-day doubling of total Oklahoma cases.
  We had about 110,000 confirmed cases on October 22nd. We now have 220,000 total cases. About 31,000 cases are deemed 'active.
  The active caseload is the area of public health concern to state officials. Quality care is important to keeping the fatality count low. Without access to proper medical resources, about 10% of those infected will face a compounded difficulty.  It's the one legitimate area of public health where moderating the spike is a rational argument for public cooperation.

Will Oklahoma Join the Texas Lawsuit Against 'Tainted' States?

 Late Monday night, Texas filed a federal lawsuit against Pennsylvania and 3 other states where election laws were improperly changed without legislative authorization in those states.
​ In the 4 states the election rules were diverse from county to county, without legislative approval; weakening the US 14th Amendment guarantees of 'equal protections under law'.
   Because the nature of the lawsuits is state vs state, the US Supreme Court is the immediate venue of deliberations.  It's a move which seeks to bar electors from being federally recognized in the weeks to come.
  The move is bold and hearkens to the legacy of Ted Cruz, who used to hold the role on behalf of Texas, for the State of Texas. It's a move which Oklahoma would do well to stand in solidarity with.  Gov. Kevin Stitt needs to decide if Oklahoma has the resolve to stand with the 'Lone State State'.

As soon as We suppress or delete even one posting, we become an endorser of whatever We didn't censor..The publisher doesn't (and could not) logically agree with all the content, so we would not expect any rational reader to agree, either. What we do hope, is that readers will think for themselves, and at least be better informed of the issues, events, and values that our citizen journalists work hard to provide for free..
