Desperate for campaign funds and moral victories, Rep Jason Lowe (D-OKC) is taking our constitutional rights to the Oklahoma Supreme Court. He'll rest all his legal arguments against the bill of rights on a technicality known as the 'Oklahoma Single Subject Rule'. It's been a favorite tool of our activist court in the past couple decades.
Lowe now says that even the historic phrase in the Bill of Rights would be a violation of the single subject. Incredulously, Lowe says keeping arms an bearing arms must be dealt with in two completely separate pieces of legislation. Lowe filed the lawsuit earlier today. He previously fell short on a referendum petition, in August. He only needed 59,000 signatures to hold a ballot decision on the newly restored constitutional rights. But even with about 6 months since the bill became law, his political allies only came up with 37,000 alleged signatures. And even several of those were questionable, not to mention the lawsuit against that petition based on false data included in the proposal. |

Lowe said the permitless carry law violates the "single subject rule," which requires bills that are passed only be about “one subject” that is “clearly expressed” in the title of the bill. Advocates argue that the permitless carry bill also mentions other types of weapons including knives, and that it doesn’t only have to do with “carrying” weapons, but also with the “use,” “possession” and “transportation" of weapons. They further argue it addresses certain types of legal immunity. Lowe is also seeking an injunction and a stay of the implementation of this law, which is scheduled to go into effect on November 1st. |
